POST COVID-19 HIGHER LEVEL HOOPS WAIVER In consideration of being allowed to participate in any way in the Higher Level Hoops basketball camp, athletics/sports program whether involving team or individual sports and related events and activities, the undersigned acknowledges, appreciates, and agrees that: 1. The risk of injury and/or illness from the activities involved in the program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist; 2. The risk to have direct or indirect contact with individuals who have been exposed to and/or diagnosed with one or more communicable diseases, including but not limited to COVID-19 or other medical conditions, diseases, or maladies, and/or any mutation or variation thereof does exist and it is impossible to eliminate the risk that I could become infected through contact with or close proximity to an individual with a communicable disease; 3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, 4. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual, significant hazard during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest official immediately; and, 5. Higher Level Hoops is ministry of Free Indeed One Love Ministries which is a 501c3 registered charity. 6. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Higher Level Hoops (HLH)/Free Indeed One Love Ministries (FIOLM) and Hope Fieldhouse (HF), its officers, officials, agents and/or employees, other participants, sponsoring agencies, volunteers, directors, sponsors, and, if applicable, owners and lessors of the premises used to conduct the event (collectively, the "Releases"), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. 7. Release and Covenant Not to Sue: I, the undersigned, release, waive, discharge, and agree not to sue HLH/FIOLM and HF, and all its respective agents, affiliates, associates, officers, directors, owners, employees, interns, and volunteers (collectively “Releases”) from demands, losses, or damages on account of any bodily injury, death or property damage caused or alleged to be caused in whole or in part by Releases or any other party’s actions, inactions, or otherwise. 8. I hereby authorize HLH/FIOLM to publish photographs and videos taken during their August 9-11 basketball camp of my child or children listed below. I grant permission to use photos and videos in print, online and video-based marketing materials. 9. Emergency and medical care consent: I, the undersigned, consent to emergency medical care and transportation in order to obtain treatment in the event of an injury to me as HLH/FIOLM and HF may deem appropriate. This Release extends to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency. 10. Higher Level Hoops/Free Indeed One Love Ministries and Hope Fieldhouse are not responsible for determining whether or not any participant has or doesn’t have Covid-19 or any other illness before, during or after this camp. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
